ok then, am i right here, 4 players left only top 3 were to be paid, blinds were 2k and 4k. big and little blinds in then next to act folds, then next to act after that calls, back to small blind and calls also, leaves 3 players and big blind checks.

cards come out ACE 6 SPADES, and 7 hearts.

small blind checks, big blind checks, next player bets 4k

small blind calls, big blind folds.

TURN CARD is another spade

this is where player out of turn bets 4k and dealer said its not on you to act, so takes his 4k back........... small blind then bets over him all in with 5.5k.

player who was out of turn then said fold, others at table say bet stands, and player is adamant that if small blind checked or bet below the out of turn bet then it wud indeed stand, but because he has gone over the top of the out of turn bet, it then gives him option to fold?

from what i hav seen and heard myself is that this is true and can fold the hand without having to put the 4k in the pot.

can someone please confirm this if it is 100% correct, or would the 4k still hav to be put in the pot b4 the fold?

From what I understand the bet doesn't stand in this situation. As there was action taken that makes the 4k bet not acceptable.

The dealer should have kept the 4k in the pot until the players who's turn it actually was had acted since his decision determines what happens to the 4k.

Erm for future reference what the guy should have done is checked - the guys 4k then would have been forced to stand then he could have re-raised all-in over the top.

This depends one where you are playing as different casinos will have different house rules on this situation. I think all three Newcastle casinos have the same rule - the action has changed in front of him, so the bet doesn't stand and he only has the option to call or fold - he wouldn't be allowed to raise if he had enough chips to do so.
